More than six months after denouncing the Nicaraguan government for attempting to occupy part of their sprawling beachfront property in Tola, Walter Bühler, owner of the Punta Teonoste eco-hotel, claims his problem with the Sandinista administration has not yet been resolved.

Bühler, a Swiss-Nicaraguan dual citizen, says the ongoing saga over his property rights has remained out of the press for the past five months, but nothing has changed since the day armed agents from the Prosecutor General’s Office (PGR) forcibly occupied a plot of land adjacent to their hotel.

“The case is not resolved, and we are still not willing to cede land,” Bühler told The Nicaragua Dispatch in a recent interview. “The Prosecutor General’s Office has not advanced on the issue. Now they aren’t even interested in measuring the property because they know what they are doing is wrong and that our title is in order. They are no longer insisting they are right, now they are just saying we need to give them 10 manzanas (17.5 acres) of land.”

In Nicaragua there are laws that prohibit charging tip, but most of the establishments included in the bill

Is it voluntary or mandatory payment of gratuity? It is perhaps one of the most recurrent questions when visiting a restaurant, a bar, club or hotel, which usually gets used include such charges in the customer invoice.Payment of this fee “voluntary” sometimes becomes bitter taste to the palate when the service you receive is poor in quality.

Nicaraguan laws clearly state that “tipping is voluntary” and that should not be included in the invoice payment.“It is forbidden to all tourism service providers include amounts in respect of gratuities or additional payments, users are not required to make this payment,” reads part of Article 60, paragraph F, of the General Law of Tourism, Act 495.

Although the Act is explicit, Mercedes Jimenez, sales executive of a company in Garden City, says that feels obligatory. Remember the last time it was lunch at a food establishment in that area asked to exclude from the bill tip because this time did not have enough cash to cover the cost of the service. He had received a good service, says.

It had not been three minutes since I asked the waiter for the bill withhold payment of gratuity when she approached the store owner to inquire why he was making such a request. “Honestly I felt depressed and since I did not volunteer,” he says.

According to the representative of the Nicaraguan Institute of Consumer Defense Institute (INDEC), Marvin Pomares, complaints by the payment of gratuity are common sites of service providers.This despite the fact that there are severe sanctions that punish this type of action, but not implemented by the Directorate General of Consumer Protection Institute of the Ministry of Development, Industry and Trade (Mific).

The problem-as-Pomares is implicitly such charges become mandatory when the establishments included in the bill, although in the same clear that it is voluntary. “This is a matter that violates the rights of consumers, as there is a law prohibiting it” reaffirms.

Even-as-Pomares sites charge no more than ten percent of total consumption, even knowing that the service has been bad.Recognizes that it is good to reward good care at a local, but that royalty should be born of the will of the client and leave right at the table, for example.

The deal here is that when you come and visit Nicaragua and go out to a restaurant, on the bill will be the total of what you consumed plus taxes.  In addition, there will be a line saying “Propina Voluntario” which means “Voluntary Tip.” It is typically and additional 10% and should be the pre-tax amount (which is a VAT of 15% known as an IVA in Spanish).

Usually this is fine; but what do you do if you get horrible service, the order comes out wrong, or you just feel somewhat abandoned by the wait staff, and decide not to pay the 10%? Sometimes the manager will come around after you pay and kind of make sure that you know that your forgot to tip. Then he or she might want to know why, etc. It can be kind of uncomfortable. I think I’ve not paid the suggested tip only one time because of lousy service, and it did raise eyebrows (if not the ire) of the staff.

Just know that if you decide not to pay the “voluntary tip” you are within your rights as a consumer and are under no compulsion to explain why. The other reason not to pay the propina voluntario is if you are paying with a credit card. The wait staff usually prefers a cash tip, so I just pay the amount owed pre-propina and leave cash on the table or hand it to the waiter so he or she knows they are not losing out on the gratuity.

Just say no to motorboats was the target of a journey of 21 miles by kayak conducted on Lake Apoyo, by Nicaragua’s Marcelo Gutierrez and the German Alexander Müller.

The boys explained that they also intend to promote friendly sports in the lagoon to avoid contamination.

“We set out to go around the lagoon, and it was a very pleasant and natural experience. At the far end one can listen to nature, such as birds, monkeys, and we saw lots of fish. This lake has no river to drain and have to be very careful and aware with it,” said Marcelo.

Alvaro Gutierrez, head of the Visitors Center of Laguna de Apoyo, said they are committed to support good environmental causes in this reserve.

“From our office we make the call to enjoy sports friendly to the natural reserve, and that are environmentally responsible, because the Apoyo Lagoon deserves the respect of all Nicaraguans and foreigners who visit,” the official estimated.

The team’s kayak were provided by the Apoyo Cultural Center, under the direction of the U.S. citizen Kenneth McKaye and his children Markc and Lara.
